Privacy Policy

Pocket Elite LLC ("Pocket Elite," "we," "us," or "our") operates the SlapPocket mobile application, the Entrepreneur Operator mobile application, the SoundMashify mobile application (currently forthcoming), the Log Walker mobile application (currently forthcoming), other apps we may publish under Pocket Elite LLC (together, the "Apps"), and the website at https://pocketelite.store (the "Website"). This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information when you use our Apps and Website (collectively, the "Services").

This Policy is designed to meet Apple App Store Review Guidelines (including Guideline 5.1 Privacy), App Store privacy nutrition labels, in-app account deletion where accounts exist, App Tracking Transparency requirements, U.S. state privacy laws, and GDPR/UK GDPR standards. It is a notice of our practices. Using the Services does not, by itself, constitute consent to processing where consent is required by law. Where we rely on consent, we will ask for it separately (including through iOS permission prompts), and you may withdraw consent at any time through device settings or by contacting us.

1. Apps Covered

This Policy applies to all Pocket Elite LLC products, including:

  • SlapPocket — an entertainment iOS app available on the Apple App Store. SlapPocket uses on-device motion to detect a slap and play sounds.
  • Entrepreneur Operator — an iOS life-simulation / entrepreneurship game available on the Apple App Store. Progress, preferences, and purchase entitlements are primarily stored on device. Any additional data practices unique to Entrepreneur Operator are reflected in its App Store privacy labels and, if material, in this Policy.
  • SoundMashify — an iOS sound-collab app currently in development and coming soon to the App Store. You record or import audio, invite friends, and mash sounds together. Audio, mash projects, and related metadata are stored on your device. SoundMashify does not operate a Pocket Elite backend and does not require a Pocket Elite account. When it launches, this Policy will apply to it. Any additional data practices unique to SoundMashify will be reflected in its App Store privacy labels and, if material, in an update to this Policy.
  • Log Walker — an iOS arcade game currently in development and coming soon to the App Store. Game progress (such as scores, coins, Embers, skins, and settings) is primarily stored on device. When it launches, this Policy will apply to it. Any additional data practices unique to Log Walker will be reflected in its App Store privacy labels and, if material, in an update to this Policy.
  • Website — pocketelite.store, including our contact, privacy, and terms pages.

Data practices can vary by app and by the features you use. We collect only what is reasonably necessary for the relevant Service. Each App's App Store product page includes Apple's required privacy nutrition labels, which summarize collection for that App. Paid features do not require you to grant optional data-access permissions.

2. Information We Collect

We may collect the following categories of information. We do not collect a category unless the relevant App or Website feature actually uses it.

2.1 Information You Provide Directly

  • Contact and support information: name, email address, and the contents of messages you send through the Website contact form, email, or in-app support.
  • Account information (if offered): if an App later offers accounts, we may collect a display name, email address, username, and authentication credentials. Passwords, if stored by us, are stored in encrypted or hashed form. SlapPocket, Entrepreneur Operator, SoundMashify, and Log Walker do not currently require a Pocket Elite account.
  • Profile or user content (if offered): optional profile details or content you create, upload, or store in an App, as applicable to that App's features.
  • Preferences: settings you choose in an App, such as sound packs, sensitivity, music, haptics, view mode, or notification preferences.

2.2 Information Collected Automatically

  • Device information: device type, operating system version, app version, language, and similar technical identifiers reasonably needed to operate the App. We do not use the advertising identifier (IDFA) for cross-app tracking.
  • Usage and diagnostics: features used, session duration, crash logs, performance data, and coarse in-app activity needed to keep the Services working and to fix bugs.
  • Log data: IP address, access times, referring pages, and diagnostic information when you use the Website or, if applicable, backend services.
  • Approximate location: general location derived from IP address (for example, city or country). We do not collect precise GPS location unless a specific feature requires it and you grant permission.

2.3 Motion and Device Sensors (SlapPocket)

SlapPocket uses the device accelerometer and related motion sensors on-device to detect a slap or similar movement and to play sounds. Motion processing is performed on your device to deliver the core entertainment feature. We do not use motion data to infer health, fitness, or other sensitive characteristics, and we do not sell motion data. If motion data is ever transmitted off-device (for example, aggregated diagnostics), it will be limited to what is needed to operate or improve the App and will be reflected in SlapPocket's App Store privacy labels.

2.4 On-Device Gameplay Data (Entrepreneur Operator and Log Walker)

Entrepreneur Operator and Log Walker store gameplay progress locally on your device using standard app storage (for example, save files and preferences). This may include:

  • Entrepreneur Operator: character choices, career and business progress, in-game currency balances (such as Willow Coins), unlocks, mission status, and settings.
  • Log Walker: coins, Embers, unlocked skins, power-ups, high scores / best distance, music and haptics settings, and similar progress.

This on-device data is used to operate the games. Deleting an App from your device typically removes that App's local data.

2.5 On-Device Audio and Mash Data (SoundMashify)

SoundMashify is a local sound-collab app. It does not upload your audio, contacts, or project data to a Pocket Elite server, and it does not use an analytics SDK or the advertising identifier in the current design. On-device data may include:

  • Mash projects, participant display names you enter, and recording metadata
  • Audio you record with the microphone or import from files you choose
  • Final mixes you create
  • A local record of whether SoundMashify+ is unlocked, based on Apple StoreKit receipts

The microphone is used only when you choose to record a sound and grant permission. You can deny or later revoke access in iOS Settings; recording will not work without it. If you share an invite, a recording, or a final mix, you use Apple's share sheet (Messages, AirDrop, Mail, Files, and similar). Those services are provided by Apple and follow Apple's privacy terms. Deleting SoundMashify typically removes that on-device data.

2.6 Purchase and Transaction Information

If you make in-app purchases or subscriptions (for example, Embers in Log Walker, Willow Coins or Premium Pass in Entrepreneur Operator, SoundMashify+, or other paid features), Apple processes your payment. We may receive transaction confirmation data (such as product identifier, date, and subscription or purchase status) so we can unlock features. We do not receive or store your full payment card number, Apple ID password, or billing address from Apple.

2.7 Advertising and Analytics (If Enabled)

Some Apps may later include optional analytics, crash reporting, or advertising (including rewarded ads). If we integrate third-party SDKs for those purposes:

  • We will disclose the data types in the relevant App's App Store privacy labels.
  • We will update this Policy if material new collection begins.
  • Any tracking that requires Apple's App Tracking Transparency (ATT) permission will only occur after you grant consent. You can change this later in iOS Settings.
  • We will not share personal data with third-party advertising or AI providers for their own purposes without first obtaining your explicit permission where required by Apple or applicable law.

Until such frameworks are enabled and disclosed, our focus is on-device gameplay and Apple-handled purchases.

2.8 Information from Third Parties

  • If you sign in with a third-party service (such as Sign in with Apple), we may receive information that service is authorized to share, such as a name and email address (or Apple's private relay email).
  • Apple may provide App Store analytics and purchase status as described in Apple's terms.
  • Analytics, crash-reporting, or advertising providers, if used, may collect technical data on our behalf as described in Sections 2.7 and 6.

2.9 Information We Do Not Collect

Unless a future feature clearly requires it and we disclose it, we do not collect Social Security numbers, government IDs, precise geolocation, health or medical records, financial account numbers, contents of SMS or call logs, contacts, or photos. We do not upload microphone audio to Pocket Elite servers. SlapPocket plays sounds; it is not designed to record your voice. SoundMashify may record microphone audio on your device when you grant permission and choose to record; that audio stays on device unless you share it yourself through Apple's share sheet. In-game chatbots or NPC dialogue (for example, fictional AI characters in Entrepreneur Operator) are entertainment features and are not used to harvest personal data for third-party AI training.

3. How We Collect Information

  • Directly from you when you contact us, use App features, or (if offered) create an account or make a purchase.
  • Automatically through the Apps and Website, including SDKs, cookies, and similar technologies as described in Section 7.
  • From Apple regarding App Store distribution, in-app purchase status, subscriptions, and, where applicable, Sign in with Apple.
  • From service providers acting on our instructions.

4. How We Use Your Information

We use personal information for the following purposes:

  • To provide, operate, maintain, and improve the Services, including SlapPocket's slap-to-sound feature, Entrepreneur Operator, SoundMashify, and Log Walker.
  • To personalize in-app settings you choose and remember preferences and progress on your device.
  • To process in-app purchases and manage entitlements or subscriptions, if offered.
  • To respond to support requests, feedback, and privacy rights requests.
  • To monitor performance, diagnose crashes, and improve stability and usability.
  • To detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms of Service.
  • To send service-related notices (for example, material changes to this Policy). We do not send marketing emails unless you opt in, and you can opt out at any time.
  • To comply with law, enforce our agreements, and protect the rights, safety, and property of Pocket Elite, our users, and others.

We do not use your personal information to train third-party generative AI models. We do not use the Services to build a marketing profile of you for sale to data brokers. We do not sell personal information.

5. Legal Bases (EEA, UK, and Switzerland)

If you are in the European Economic Area, the United Kingdom, or Switzerland, we process personal information only when we have a legal basis:

  • Contract: to provide the App or Website features you request.
  • Legitimate interests: to secure, debug, and improve the Services, prevent abuse, and understand aggregate usage, in ways that do not override your rights.
  • Consent: where required (for example, optional analytics, tracking, ATT, or marketing). You may withdraw consent at any time without affecting prior lawful processing — including by changing iOS permission settings or contacting us.
  • Legal obligation: to comply with applicable law, including responding to valid legal process and retaining records we are required to keep.

You may lodge a complaint with your local data protection authority. We encourage you to contact us first so we can try to resolve your concern.

6. How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We may disclose information only as follows:

6.1 Service Providers

We use trusted vendors who process data on our behalf, which may include:

  • Cloud hosting and storage
  • Analytics and performance monitoring
  • Crash reporting and diagnostics
  • Advertising or rewarded-ad networks, if enabled and disclosed
  • Email and customer support tools
  • Authentication services, if accounts are offered

These providers are permitted to use personal information only to perform services for us and are required to protect it with appropriate safeguards. Where Apple requires explicit permission before sharing personal data with third parties (including third-party AI), we will obtain that permission first.

6.2 Apple

Distribution, in-app purchases, subscriptions, Sign in with Apple, and related platform services are provided by Apple. Apple's handling of your information is governed by Apple's Privacy Policy.

6.3 Legal and Safety

We may disclose information if we believe it is required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Pocket Elite LLC, our users, or others.

6.4 Business Transfers

If Pocket Elite LLC is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction. We will provide notice of any material change in ownership or use, and any choices you may have, as required by law.

6.5 With Your Direction

We may share information when you ask us to (for example, if you email us and copy a third party, or if an App feature you enable shares content you choose).

7. Tracking, Advertising, Cookies, and Similar Technologies

Our Apps are not designed for cross-app tracking or third-party targeted advertising by default. We do not currently use your data for third-party advertising networks. If we ever implement tracking that requires permission under Apple's App Tracking Transparency (ATT) framework, we will request your consent before accessing the advertising identifier (IDFA). You can control tracking in iOS: Settings > Privacy & Security > Tracking. Apps will not require you to enable tracking, push notifications, or other optional system permissions to access core paid functionality.

The Website may use strictly necessary cookies or similar storage to operate the site (for example, to remember a UI preference). We do not currently use advertising cookies. If that changes, we will update this Policy and, where required, provide a cookie notice or controls.

We honor Global Privacy Control (GPC) and similar legally recognized opt-out preference signals as a request to opt out of "sale" or "sharing" of personal information for cross-context behavioral advertising. Because we do not sell or share personal information for that purpose, these signals confirm an existing practice.

8. Data Retention

We retain personal information only as long as needed for the purposes described in this Policy, unless a longer period is required or permitted by law. Typical periods:

  • Support communications: up to 3 years, unless you ask us to delete sooner and we are not legally required to keep them.
  • Account data (if any): while the account is active, then a reasonable period to close the account, resolve disputes, and meet legal obligations.
  • Diagnostics and logs: typically up to 24 months in identifiable form; we may keep aggregated or de-identified data longer.
  • Purchase records: as required for tax, accounting, fraud prevention, and legal compliance.
  • On-device data: remains on your device until you delete the App or clear App data through iOS settings.

When information is no longer needed, we delete or de-identify it using reasonable measures.

9. Your Rights and Choices

Depending on your location, you may have some or all of the following rights. We will not discriminate against you for exercising them.

  • Access / know: request a copy of the personal information we hold about you and, where required, details about how we use it.
  • Correction: request that we correct inaccurate or incomplete personal information.
  • Deletion: request that we delete personal information, subject to legal exceptions (for example, records we must keep for tax or security).
  • Portability: request a copy of certain information in a portable format.
  • Restriction / objection: ask us to limit or stop certain processing, including processing based on legitimate interests.
  • Withdraw consent: where we rely on consent, withdraw it at any time through iOS Settings, in-app controls, or by contacting us. Withdrawal does not affect prior lawful processing.
  • Opt out of sale, sharing, and targeted advertising: we do not sell or share personal information for cross-context behavioral advertising. You may still submit an opt-out request.
  • Limit use of sensitive personal information: we do not use sensitive personal information to infer characteristics about you. Motion data in SlapPocket is used only to operate the slap-to-sound feature. Microphone audio in SoundMashify is used only to create the recording you choose to make.
  • Appeal: if we decline a request, you may appeal by emailing us and writing "Privacy Appeal" in the subject line. If you remain unsatisfied, you may contact your state attorney general or data protection authority.

9.1 How to Submit a Request

Email hello@pocketelite.store or use our contact page. Please tell us which App or Website the request concerns. We will verify your request using the email address or other information reasonably associated with your use of the Services. You may use an authorized agent where the law allows; we may require proof of authorization and identity. We aim to respond within 30 days, or within the time required by applicable law (typically 45 days for certain U.S. state laws, with a permitted extension when reasonably necessary).

9.2 Account Deletion

If an App offers accounts, Apple requires an easily accessible in-app way to delete the account and associated data. Use that in-app control where available, or contact us. Deleting the App from your device removes on-device data but may not delete information stored on our servers; submit a deletion request for that.

9.3 California and Other U.S. State Residents

Residents of California and other U.S. states with comprehensive privacy laws (including, as applicable, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, Rhode Island, and others as they take effect) have the rights listed above to the extent those laws apply. In the last 12 months we have not sold personal information or shared it for cross-context behavioral advertising. Categories we may collect are those described in Section 2; we use them for the business purposes in Section 4; and we disclose them to the categories of recipients in Section 6.

California residents may also request information about disclosures of personal information to third parties for those parties' direct marketing, under California's "Shine the Light" law. We do not make such disclosures.

10. Children's Privacy

The Services are not directed to children under 13 (or the higher age of digital consent in your country). We do not knowingly collect personal information from children. SlapPocket and Entrepreneur Operator are rated 4+ on the App Store as entertainment experiences; that rating does not mean we seek information from young children. SoundMashify and Log Walker will carry age ratings appropriate to their content when listed on the App Store. If we learn that we have collected personal information from a child without required parental consent, we will delete it. Contact us if you believe a child has provided personal information.

11. Data Security

We use reasonable technical and organizational measures appropriate to the nature of the information, which may include encryption in transit (TLS), access controls, least-privilege practices, and vendor due diligence. No method of transmission or storage is completely secure. Please use a strong device passcode and keep iOS updated.

12. International Data Transfers

Pocket Elite LLC is based in the United States. If you use the Services from another country, your information may be processed in the United States or other countries where we or our providers operate. Those countries may have different data-protection laws than your own. Where required, we use appropriate safeguards for international transfers, such as standard contractual clauses.

13. Automated Decision-Making

We do not use personal information for automated decision-making that produces legal or similarly significant effects about you (for example, eligibility for credit, housing, or employment).

14. Do Not Track

Some browsers offer a "Do Not Track" signal. There is no consistent industry standard for responding to DNT. We do not use DNT to change collection, but we do honor GPC as described in Section 7 and we do not engage in cross-context behavioral advertising.

15. Changes to This Privacy Policy

We may update this Policy from time to time, including when SoundMashify or Log Walker launches or when the law or our practices change. We will revise the "Last Updated" date and, for material changes, provide additional notice as appropriate (for example, an in-app notice, a Website banner, or email if we have your address). If a change requires consent, we will request it before applying the new practice to your information. You can always find the current Policy at https://pocketelite.store/privacy.html, which is the Privacy Policy URL we provide in App Store Connect and within our Apps.
